Terms of Service

These terms are the agreement between you and us for using the Not Your Phone app and this website. By installing or playing the game, you accept them. If you do not accept them, please do not use the service.

1. The service

Not Your Phone is an anthology mystery game. Each case places you inside a simulated phone that belongs to a fictional character, and asks you to answer questions using what you find. The operator of the Service is referred to below as "we" or "us".

Story content is delivered from our servers while you play. An internet connection is required.

2. Everything in the game is fiction

Every character, message, photo, note, location, browsing record, and event in the game is written and produced by us as fiction. Any resemblance to a real person, a real account, or a real event is unintended.

The app does not access, read, copy, or display data from your own device or from anyone else's device or accounts. Nothing in the game is a tool for reading another person's phone, and the game must not be described or promoted as one.

3. Who can play

You must be at least 13 years old, or older where your country requires a higher age. The cases deal with adult relationships and their consequences, so please respect the age rating shown on the App Store or Google Play listing. If you are a minor in your jurisdiction, you may use the service only with the consent of a parent or guardian.

4. Your player identity

The app creates an anonymous identity on your device the first time you open it. There is no username and no password for you to remember, which also means there is no way for us to recover an identity from a device you no longer have.

If you lose that identity, progress and any story you unlocked by watching an ad are lost with it. A Pro purchase is not lost. It can be restored through the store you bought it from, using the restore option in the app.

5. Purchases and subscriptions

Not Your Phone Pro is available as a renewing yearly subscription or as a one-time purchase. Both open every case in the anthology.

• All purchases are processed by the Apple App Store or Google Play, under that store's terms. Prices and the currency shown are set per region by the store.
• A subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Your store account is charged at confirmation of purchase and again on each renewal.
• You manage and cancel a subscription in your store account settings, not in the app. Deleting the app does not cancel a subscription.
• Refunds are handled by the store under its own policy. We cannot issue a refund for a store transaction, but write to us if something went wrong and we will help where we can.
• If we change the price of a subscription, the change applies from your next renewal and the store will notify you as its rules require.

6. Rewarded ads

You can unlock a single case by choosing to watch a rewarded ad. Ads are optional and never interrupt play. An unlock earned this way is tied to your anonymous identity on that device and is not transferable.

Ad availability depends on the ad network and is not guaranteed. Attempting to fake an ad reward, or to obtain an unlock without watching an ad, is a breach of these terms.

7. Your licence to the content

The stories, characters, artwork, audio, interface, and code are owned by us or licensed to us, and are protected by copyright. We grant you a personal, non-exclusive, non-transferable, revocable licence to play the game on devices you control, for your own non-commercial enjoyment.

You are welcome to stream or record your playthrough and to share screenshots. You may not republish the story text or assets as a standalone work, or use them to train a machine-learning model.

8. Things you may not do

• Access our content servers other than through the app, including scraping, automated requests, or bulk downloading story content.
• Circumvent the paywall or the ad-unlock mechanism, or tamper with entitlement or progress records.
• Reverse engineer, decompile, or modify the app, except where the law allows it.
• Resell, sublicense, or rent access to the game or to any case.
• Use the service to break the law or to harm the service or other players.

9. Availability and changes

We may add, change, or retire cases and features, and we may suspend the service for maintenance. We aim to keep the service available, but we do not promise uninterrupted access. If we ever discontinue the service entirely, we will give reasonable notice through the app or this website.

We may update these terms. The date at the top of this page shows when they last changed. For material changes we will give notice in the app before they take effect, and continuing to play after that means you accept the new terms.

10. Disclaimer

The service is provided as is and as available. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the game is free of errors, or that a case is solvable within any particular time.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost data or lost progress. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection rules in your country.

12. Termination

You may stop using the service at any time by deleting the app. We may suspend or terminate access if you materially breach these terms, in particular section 8. Sections 7, 10, 11, and 13 survive termination.

13. Jurisdiction

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over our place of business. This does not remove any protection you have under the mandatory consumer law of the country where you live.
